We'll always do our best to fulfil your needs and meet your expectations, but it's important to have things written down so that we both know what's what, who should do what and when, and what will happen if something goes wrong. . We don't want to trick you or make you agree to something that you might later regret. What we do want is what's best for both parties, now and in the future.
So although the language here is simple, the intentions are serious.
We create designs iteratively and use predominantly HTML and CSS so we won't waste time mocking up every template as a static visual. Sometimes may use static visuals to indicate a look-and-feel direction (colour, texture and typography), we call that 'design atmosphere.'
You'll have opportunities to review our work and provide feedback. During the feedback phase we're happy for you to find problems, it's our job to find the design solutions. If, at any stage, you're not happy with the direction our work is taking, you'll pay us in full for everything we've produced until that point and cancel this contract.
Unless stated in the contract we're not responsible for writing any new text copy. If you'd like us to write new content we can provide an estimate for that.
If you're providing us with photos or graphics for your website you should supply graphic files in an editable, vector digital format, and photographs in a high resolution digital format. If you choose to use stock photographs, we can suggest some to you.
We deliver templates developed from HTML5 markup, CSS2.1 + 3 stylesheets for styling and unobtrusive Javascript for feature detection, poly-fills and behaviours.
Browser testing no longer means attempting to make a website look the same in all browsers or on devices with different size screens. What we do is to ensure that a person's experience of a design should be appropriate to the capabilities of a browser or device.
We test our work in current versions of major desktop browsers including those made by Apple (Safari), Google (Chrome), Microsoft (Internet Explorer), Mozilla Firefox and Opera. We'll also test to ensure Microsoft Internet Explorer 8 for Windows users get an appropriate, possibly different, experience. We won't test in other older browsers unless you specify otherwise. If you need an enhanced design for an older browser, we can provide a separate estimate for that.
Fixed-price contracts can sometimes limit you to your earliest ideas. We don't want to stifle your ability to change your mind. The price we gave you the beginning of this contract is based on the length of time we estimate we'll need to accomplish everything you've told us you want to achieve, but we're happy to be flexible. If you want to change your mind or add anything new, that won't be a problem and we'll provide a separate estimate for that.
Once your web site is live and you get feedback from your visitors you might want to make a few changes here and there. For thirty days after the site goes live we'll carry out any fixes and revisions free of charge (as long as they are within the scope of our original agreement). After those thirty days additional amends will be charged at our hourly rate.
First, you guarantee that all elements of text, images or other artwork you provide are either owned by your good selves, or that you've permission to use them. Then, when your final payment has cleared, copyright will be automatically assigned to you.
We love to show off our work and share what we've learned with other people, so we reserve the right, with your permission, to place a by-line at the bottom of your site establishing us as the web site designers, to display and link to your project as part of our portfolio and to write about it on websites, in magazine articles and in books.
We're sure you understand how important it is as a small business that you pay the invoices that we send you promptly. As we're also sure you'll want to stay friends, you agree to stick tight to our payment schedule.
If payment of any monies payable to Edward Robertson Ltd under this contract has not been made within 14 days of their due date for payment, we reserve the right to remove the web site from the Internet and/or (without incurring any liability to you the client) to suspend performance of any outstanding obligations under this contract, in each case until we have received payment in full.
If you require web hosting we will host it until not less than one month's notice is given by either you or by ourselves (notice may not be given until the we have hosted the web site for at least six months).
We can't guarantee that our work will be error-free and so we can't be liable to you or any third-party for damages, including lost profits, lost savings or other incidental, consequential or special damages, even if you've advised us of them.
We can't give any guarantee or give you any warranty that the web site will achieve any result, be available continuously, or remain free of viruses or items of a destructive nature.
Finally, if any provision of this contract shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this contract and shall not affect the validity and enforceability of any remaining provisions.
